1. Acceptance of these terms
By using this website, you agree to these Terms of Use and our Privacy Policy. If you do not agree, please do not use the site. If you use the site on behalf of an organization, you represent that you are authorized to act for that organization.
2. What Hour Moments provides
The website presents Hour Moments services and allows visitors to explore event use cases, contact us, and submit a Create Your Moment inquiry. Features, packages, availability, designs, domains, examples, and service descriptions may change over time.
Examples, mockups, sample event names, and sample subdomains shown on the website are illustrative unless expressly identified as a live client project.
3. Inquiries, proposals, and project terms
Submitting a form or sending an email is an inquiry; it does not by itself create a binding service agreement, reserve a date, guarantee a particular subdomain, or guarantee acceptance of a project. A project may be subject to a separate proposal, scope, timeline, pricing, payment terms, content requirements, or other written agreement. If separate project terms conflict with these website terms, the project-specific terms control for that project.
4. Content you provide
You retain ownership of content you own. If you provide photographs, video, audio, logos, text, guest information, links, or other materials for an Hour Moments project, you represent that you have the rights and permissions needed for us to use them for the requested project.
You grant Hour Moments a limited permission to host, reproduce, format, display, transmit, back up, and otherwise process that content only as reasonably necessary to provide, maintain, support, or complete the requested service, subject to any separate project agreement.
You are responsible for obtaining any permissions, releases, or notices required for content or personal information you choose to provide, including materials involving guests, attendees, photographers, videographers, performers, brands, or other third parties.
5. Acceptable use
You may not use the site or an Hour Moments service to:
- violate applicable law or another person's rights;
- upload or distribute content that is unlawful, fraudulent, defamatory, threatening, exploitative, or infringing;
- introduce malicious code, probe or bypass security, interfere with the site, or abuse infrastructure;
- impersonate another person or misrepresent authorization;
- harvest personal information without a lawful basis or appropriate permission; or
- use the service in a way that creates unreasonable security, legal, or operational risk.
6. Hour Moments intellectual property
The Hour Moments name, logo, site design, original text, graphics, code, and other site materials are owned by Hour Moments or used with permission and are protected by applicable intellectual-property laws. You may view and use the site for its intended purpose, but you may not copy, sell, republish, reverse engineer, or exploit protected site materials except as permitted by law or with written permission.
7. Third-party services and links
The website may use or link to third-party services, including Jotform for the Create Your Moment form, Google Fonts for web typography, and the separate Tali PH website. Third-party services are governed by their own terms and policies. Hour Moments is not responsible for third-party content, availability, security, or practices that are outside our control.
8. Availability and changes
We may modify, suspend, replace, or discontinue website features when reasonably necessary. We do not promise uninterrupted or error-free access. Maintenance, hosting incidents, network conditions, browser limitations, third-party outages, or events outside reasonable control may affect availability.
9. Disclaimers
The public website and its informational content are provided on an “as available” basis. To the extent permitted by law, Hour Moments disclaims warranties that are not expressly stated in a separate written agreement. Nothing on this site is legal, financial, or professional advice.
Nothing in these Terms excludes warranties, guarantees, or consumer rights that cannot legally be excluded.
10. Limitation of liability
To the extent permitted by applicable law, Hour Moments will not be liable for indirect, incidental, special, consequential, exemplary, or punitive losses arising solely from use of the public website, or for losses caused by third-party services outside Hour Moments' reasonable control. Any liability connected to a paid project may be further addressed in the applicable project agreement.
These limitations do not apply where liability cannot legally be limited or excluded.
11. Applicable law and mandatory rights
These Terms are governed by applicable law. Any mandatory consumer, privacy, or other statutory rights that apply to you remain in effect and are not waived by these Terms. If a dispute concerns a separately contracted project, any governing-law or dispute terms in that agreement will apply to that project.
12. Changes to these terms
We may update these Terms as the website or service changes. The current version will be posted at this URL with a revised effective date. Continued use of the site after an update means the updated terms apply from their effective date, subject to applicable law.
